Abstract

Comments on Shill Properties Ltd v Bunch (Ch D) on whether a purchaser had made a fraudulent misrepresentation to the seller that it was a "cash buyer" when its intention and expectation was that it would fund the purchase using secured finance and whether the contract was void for non-compliance with the Law of Property (Miscellaneous Provisions) Act 1989 because, at the date of exchange, the buyer's solicitor did not hold a signed contract.
