Abstract

The present article focuses on the fight against corruption in Brazil. We opted for a research on the role of the Judiciary in this phenomenon, the guidelines of criminal policy emanated from judges and the impact of precedents in the conformation of Criminal Law. For this objective, we anayzed the evolution of jurisprudential interpretation regarding the crime of passive corruption, money laundering, the use of the doctrine of “act-domination” or control and the use of coercive conduction, for such, using paradigmatic decisions for exemplificative and illustrative purposes. The focus on the Judiciary is justified by the important role played by this institution in the fight against corruption and by the extent of the effects of its decisions not only on concrete cases already submitted, but also on future decisions and, therefore, in the application of the Law as a whole, in its most dynamic form.
