Abstract

Discusses the interplay between the bad character provisions in Part 11 of the Criminal Justice Act 2003 and s.74(3) of the Police and Criminal Evidence Act 1984, which creates a presumption that a person convicted of an offence in the UK or an EU member state committed that offence.
