Abstract

1 ‘Facilitation of irregular migration’, or rather ‘facilitation of unauthorised entry, transit and residence’, is defined in Council Directive 2002/90/EC of 28 November 2002 (‘Facilitation Directive’). Article 1(1) of the Directive calls on Member States to adopt appropriate sanctions on: Article 1(2) adds a provision which gives Member States discretion not to impose sanctions with regard to the conduct defined in paragraph 1(a) where humanitarian actors are concerned. 2 ‘Facilitation of irregular migration’ is a concept specific to European Union (EU) law.
