ISM Complacency: can the criminal law help?

Abstract

Recent disasters such as the Costa Concordia in 2012 and the Sewol in 2014, and the sentences handed down to the Masters of these two vessels, have shocked the international maritime community and reminded us all once again of the importance of taking safety seriously. But what more can be done to ensure better implementation of the ISM Code and its mandatory safety culture?
