Abstract

Discusses the background and provisions of Directive 2014/23 (Concessions Directive), including its measures on: (1) its scope and its definition of a "concession"; (2) mixed contracts; (3) supply concessions; (4) the duration of concessions; (5) the award of concessions, including the structure of an award and the award criteria; and (6) the performance of concessions. Comments on the Directive's amendments to Directive 89/665 and Directive 92/13 to ensure that their remedies are fully applicable to utilities and public sector works and services concessions.
